Terms of service and privacy policy

These conditions represent the terms and conditions for using the
namemagic.co.uk service ("the Service"). The Service is provided to you ("user") on the basis that you accept the terms of this contract and that you have paid the subscription. It is a legal agreement and it sets out your rights and obligations and those of namemagic.co.uk. By completing the registration process and clicking the 'submit' button you are confirming your agreement to be bound by these terms and conditions.

1. Description of the Service
namemagic.co.uk provides an extensive range of domain names which gives you the ability to create your own email address using an alias (part before the @ symbol) and domain name of your choice to receive electronic mail ("email") via the namemagic.co.uk system.
You are responsible for providing and paying for your own access to the Internet and paying for any telephone and connection charges associated with such access.

2. Payment
You must pay the subscription fee (the "Subscription") in advance for the relevant time period (the "Service Period") you wish to subscribe for (annually), in accordance with the Subscription plan notified to you at the time of registration. The method and amount of payment for the Subscription may be varied at the sole discretion of namemagic.co.uk from time to time.
All Charges payable by you for the Services shall be in accordance with the scale of charges and rates published from time to time by us on our web site or on the Order Form (where completed) and shall be due and payable in advance of our service provision.
Charges are exclusive of 'Value Added Tax' which shall, if applicable, be paid additionally by you at the rate prescribed by law on submission by us of a proper VAT invoice;

Subject to cancellation in accordance with this Agreement all Fees and payments are non-refundable.
namemagic.co.uk reserves the right to change the Subscription Fees at any time or to add new fees or charges, on giving you reasonable notice.

Renewals

The service may be renewed provided that you pay the appropriate renewal fee on or before the relevant renewal date. It is your responsibility to ensure that you apply to renew the service at least 30 days before the renewal date and provide and maintain accurate
and up to date contact details

Your right to cancel this agreement The Consumer Protection (Distance Selling) Regulations 2000 provide that you are entitled to cancel your Subscription should you change your mind.
Your right to cancel must be exercised within seven working days of the date upon which you subscribed to the Service. However, you will only be entitled to cancel your subscription
if you have not used the Service. Your right to cancel therefore expires as soon as you either send or receive an email (from any third party) via the Service. In the event that you do wish to cancel you should notify us in writing by email at cancelations@namemagic.co.uk . If you do not
renew your subscription within the given time period your account will automatically be suspended and then deleted after 1 month if payment is not received. The email address will then offered to other parties on a first come first served basis.

3. The Provision of the Service
namemagic.co.uk will allow each member to register an alias of their choice under any available domain name up to a limit of 5 addresses per signup although no member has exclusive rights over any domain name which remains the property of the domain name registrant. namemagic.co.uk reserves the right to withdraw any of the domain names without warning. Each customer agrees to provide accurate, current and complete information in the registration process and to maintain and update the information. Each customer grants namemagic.co.uk the right to disclose to third parties certain information provided by the customer. If any information provided by the customer
is false or inaccurate, namemagic.co.uk retains the right to terminate the customers account and rights to use the Service.

4. Use of the Service
Each customers right to use the Service is personal to that customer and no customer may resell the Service (without the express prior consent of namemagic.co.uk). In particular no customer should abuse the Service or use it for any illegal purpose. The definition of abuse is at the sole
discretion of namemagic.co.uk(see clause 4.1). namemagic.co.uk may insert its own unique identifying details into every email header.

4.1. Abuse of service
namemagic.co.uk will take seriously any claims received advising of a user misusing using the service. (including spamming/harassment or sending illegal material or operations). If such a report is received the claims will be investigated and the account maybe suspended whilst this
takes place. If the claims are found to be incorrect and the account has been suspended the account will be reactivated but the period of service will not be extended. If the claim is found
to be correct your account will remain closed and no refund will be issued and information will be provided to the appropriate bodies.

5. Member password and security
Each customer will receive a password on registering for the Service. It is each customer responsibility to maintain the confidentiality of that password and customers are entirely responsible for any activity which takes place associated with any of the addresses setup in
their account. If any customer becomes aware of any unauthorised use of any of its registered names and addresses or any breach of security that member should notify namemagic.co.uk immediately.

6. Third parties
Certain links on the Service lead to websites located on servers maintained by independent third parties over whom namemagic.co.uk has no control. Accordingly namemagic.co.uk cannot accept
any responsibility or liability for any of the material contained on those websites; nor does namemagic.co.uk accept responsibility for the availability of those websites. You accept that
you are solely responsible for evaluating any goods or services offered by us or by third parties via the Service and that namemagic.co.uk will not be party to or in any way responsible for any transactions between you and third parties. Where the Service contains advertising and other
material submitted to us by third parties please note that those advertisers are responsible
for ensuring that material submitted for inclusion on the Service complies with all legal requirements. namemagic.co.uk does not accept liability in respect of any such advertisements.

7. Intellectual property rights
All the domain names available for use on the Service are the sole property of their registrant and should not be used for any commercial use without the express consent of namemagic.co.uk.
Each customer acknowledges that the content of the namemagic.co.uk site which includes but is not limited to text, software, and graphics is protected by copyright and members are not entitled to
copy or reproduce or distribute any of the content without the express permission of namemagic.co.uk. Each customer acknowledges that in addition to copyright, there are also trademarks and other
intellectual property rights in and relating to the Service which are owned by namemagic.co.uk and which are not to be used without express permission.

8. Disclaimer of warranties
Due to the connected nature of the internet namemagic.co.uk does not warrant that the Service will meet any particular requirements to the users or that the Service will be uninterrupted, that emails will be sent or received within any particular time or that the Service will be secure or error free. namemagic.co.uk does not give any warranty in respect of any goods or services purchased or obtained through the Service or any transactions entered into through the Service. namemagic.co.uk may terminate access to any part or all of the Service and any related service(s) at any time, with or without cause, with or without notice, effective immediately for any reason whatsoever. namemagic.co.uk may also terminate or suspend your account for inactivity, as determined by namemagic.co.uk. If the account is terminated for inactivity then all of your email and stored files will be deleted. namemagic.co.uk shall have no obligation to maintain any content in your account or to forward any unread or unsent messages to you or any third party.

9. Limitation of liability
Each member agrees that he or she uses the Service at their own risk. namemagic.co.uk will not accept any liability either in contract, tort (including negligence) or otherwise for any direct, indirect, incidental or consequential loss resulting from the use or the inability to use the Service. Each member agrees that any material and/or data downloaded by a member is done so entirely at their own risk and each member will be solely responsible for the consequences of downloading any such material.

You represent, undertake and warrant to us that you will use the email address allocated to you only for lawful purposes. In particular, you represent, warrant and undertake to us that you will not send
any material which is unlawful, threatening, abusive, malicious, defamatory, obscene, pornographic, blasphemous, profane or otherwise objectionable in any way; any material containing a virus or
other hostile computer program; any material which constitutes, or encourages the commission of, a criminal offence or which infringes any patent, trade mark, design right, copyright or any other
intellectual property right or similar rights of any person which may subsist under the laws of any jurisdiction;

7. BANDWIDTH UTILISATION
If the bandwidth or speed of Service used by the customer exceeds 1Gb over a one week minimum period in regular samples namemagic.co.uk reserves the right to suspend the service to the customer to ensure
continuity of its systems.

10.3 You continue to be liable to pay all charges which are due for Service during any period in which you do not comply with this Contract;

14.3 namemagic.co.uk is not in any way liable in Contract or otherwise for loss whether direct or indirect of business, revenue or profits, anticipated savings or wasted expenditure, corruption or destruction of data or for any indirect or consequential loss whatsoever.

10. Indemnity
Each member agrees to indemnify namemagic.co.uk against all liabilities, claims and expenses that may arise from any breach by the user of these terms and conditions and any liabilities claims
and expenses incurred by namemagic.co.uk in connection with any claim, action or proceeding brought by a third party as a result of the member's use of the Service.

You shall indemnify us and keep us indemnified and hold us harmless from and against any breach by you of these terms of business and any claim brought against us by a third party resulting
from the provision of Services by us to you and your use of the Services and the Server without limitation.

11. Severability
If any of the provisions of this contract is judged to be illegal, unreasonable or unenforceable the rest of these terms and conditions will continue to apply. Any delay on the part of namemagic.co.uk
to enforce its rights under this contract will not prejudice or restrict its rights and no waiver of any such rights will be deemed to be a waiver of any other right or of any later breach.

12. Notices
Any notices sent pursuant to this agreement will be effective if sent by email to the member's contact email address 24 hours from the time of sending.

13. Applicable law
These terms and conditions will be governed in accordance with the laws of England and Wales. Customers and namemagic.co.uk agree to submit to the exclusive jurisdiction of the courts of England and Wales.
